1. Introduction

Aviro App is a technology-enabled marketplace that connects Customers with independent Service Providers and Handymen. By using the App, you agree to these Terms.

Aviro App acts solely as an intermediary under the Information Technology Act, 2000, and does not directly provide home services unless explicitly stated.


2. User Eligibility
  • Users must be at least 18 years old.

  • Accurate and complete registration information is required.

  • Accounts may be suspended or terminated for fraudulent activity or violation of Terms.


3. Platform Role
  • Aviro App connects Customers and Service Providers for service bookings.

  • Service Providers are independent contractors, not employees or agents.

  • Aviro App is not responsible for the execution, quality, or safety of services.


4. Bookings & Service Responsibility
  • Bookings are subject to availability.

  • Service Providers are responsible for service quality, compliance, and safe execution.

  • Customers must provide accurate service information and access to premises.

  • Disputes between Customers and Service Providers are subject to arbitration (see Clause 12).


5. Payments, GST & Commission
5.1 Payment Methods
  • Payments are made through RBI-compliant payment gateways.

  • Aviro App may offer in-app Wallet functionality.

5.2 GST Compliance
  • GST will be applied to platform service fees where applicable, as per Central Goods and Services Tax Act, 2017.

  • Service Providers are responsible for their own GST compliance, invoicing, and filings.

  • Customers will receive GST-compliant invoices where applicable.

5.3 Commission & Fees
  • Platform commissions, service fees, and payment processing fees are disclosed transparently.

  • All applicable taxes are the responsibility of the party specified.


6. Wallet Policy (RBI Compliance)
  • The Wallet is a prepaid stored value mechanism for in-app transactions only.

  • Wallet operations comply with RBI guidelines where the Wallet qualifies as a Prepaid Payment Instrument (PPI).

  • KYC verification may be required for Wallet usage.

  • Wallet funds are non-transferable outside the App unless legally permitted.

  • Promotional credits may have expiry dates.

  • Suspicious or non-compliant transactions may result in temporary freezing.


7. Cancellation & Refund Policy
  • Customers may cancel bookings according to the cancellation policy.

  • Cancellation after service confirmation may incur fees.

  • Refunds are processed within 7–10 working days for bank payments.

  • Wallet refunds may be processed instantly.

  • No refunds are given after verified service completion except for disputes resolved via arbitration.


8. User Conduct

Users shall not:

  • Provide false or misleading information

  • Engage in fraudulent or abusive behavior

  • Circumvent App payment systems

  • Violate any applicable laws or regulations


9. Limitation of Liability
  • Aviro App shall not be liable for indirect, incidental, or consequential damages.

  • Liability is limited to the service fee paid for the disputed transaction.

  • Aviro App is not responsible for property damage, personal injury, or disputes between Users.


10. Indemnification

Users agree to indemnify and hold Aviro App, its affiliates, directors, and employees harmless from:

  • Claims, damages, or losses

  • Legal or regulatory penalties

  • Misuse of the platform or violation of Terms


11. Privacy & Data Protection
  • Aviro App complies with the IT Act, 2000, SPDI Rules, 2011, and Digital Personal Data Protection Act, 2023.

  • Information collected includes name, contact details, payment information, service location, and usage data.

  • Data is used for account management, service delivery, payment processing, fraud prevention, and customer support.

  • Users may request access, correction, or deletion of their personal data.


    12. Arbitration Clause
  • All disputes arising out of or relating to these Terms shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996.

  • Arbitration shall be conducted in English by a mutually agreed sole arbitrator.

  • The arbitral award is final and binding.

  • Parties must attempt good-faith negotiation for 30 days before initiating arbitration.


13. Force Majeure

  • Natural disasters, acts of God

  • Government restrictions or regulations

  • Payment network or internet failures

  • Regulatory changes


14. Modification of Terms
  • Aviro App may revise Terms to comply with legal requirements or business needs.

  • Continued use constitutes acceptance of updated Terms.


15. Governing Law
  • These Terms are governed by the laws of the Republic of India.

  • Arbitration as outlined in Clause 12 replaces court litigation for dispute resolution.

Aviro App is positioned as:

  • A commission-based marketplace for home services.

  • A technology intermediary, minimizing legal exposure.

  • A GST-compliant and RBI-aligned digital transaction platform.
